Acceptable Use Policy

1 Purpose

Caznet provides business telecommunications services and we want our customers to get the most out of them. We also believe that there should be clear rules around how our services are used to ensure:

  • the safety and rights of all users and Caznet are protected;
  • our services are not used in an unreasonable or unacceptable manner; and
  • the quality of service we deliver to all customers is maintained.

This Acceptable Use Policy (AUP) sets out those rules and explains what action we may take if you breach them.

2 Definitions

Caznet Caznet Pty Ltd (ABN 47 143 897 303), including its officers, employees and contractors.
Customer Any business or organisation that holds an account with Caznet for the supply of services.
Services All services supplied by Caznet, including internet access, voice and phone system services, managed network services, and data centre co-location.
Spam Unsolicited commercial electronic messages with an "Australian link", as defined under the Spam Act 2003 (Cth).
You The account holder and any person the account holder has authorised to access or use the services.

3 Respecting others

You must not use our services to:

  • promote, threaten or facilitate violence towards any person;
  • abuse, harass, stalk or intimidate any person, including Caznet staff;
  • make offensive, menacing or discriminatory communications of any kind;
  • encourage or incite hatred on the basis of race, religion, gender, sexuality or any other characteristic;
  • create a risk to the health or safety of any person; or
  • send Spam or otherwise transmit unsolicited commercial electronic messages.

4 Respecting the law

You must not use our services for any purpose that is illegal or unlawful under Australian law. This includes, but is not limited to:

  • providing Caznet with false or misleading account information;
  • gaining or attempting to gain unauthorised access to any system, network, account or data;
  • transmitting or storing data that infringes Australian law, including material that is prohibited, defamatory or malicious;
  • distributing or facilitating the distribution of malware, viruses, ransomware or other harmful code;
  • sending Spam or assisting in the sending of Spam in breach of the Spam Act 2003 (Cth);
  • infringing the intellectual property rights of any person, including through unlawful copying or distribution of copyright material; or
  • any other activity that contravenes applicable law or regulation.

5 Respecting Caznet's network and suppliers

You must not use our services in a way that adversely affects Caznet's network, infrastructure, reputation or other customers. This includes, but is not limited to:

  • using our services in a manner that is unreasonable, excessive or outside the intended purpose of the service;
  • resupplying or reselling our services or network capacity to third parties without our prior written consent;
  • causing or contributing to interference, disruption, congestion or degraded performance on our network or the networks of our wholesale suppliers;
  • using our services in a way that breaches our agreement with NBN Co or any other wholesale supplier; or
  • using a service at a location or in a manner not authorised under your service agreement.

6 Service-specific requirements

In addition to the above, the following requirements apply to specific services.

Internet services (NBN, Enterprise Ethernet, Fibre)

You must not, without authorisation:

  • disable, disrupt or interfere with the operation of any network service, including through denial-of-service attacks, network flooding or similar means;
  • probe, scan or test the vulnerability of Caznet's network or systems, or the networks or systems of any third party reachable via our services;
  • breach or attempt to breach the security or authentication measures of any system or network; or
  • use a single service connection to serve multiple premises or aggregate traffic from multiple end-users without explicit agreement from Caznet.

Voice and phone system services (Cloud PBX, SIP Trunks, Microsoft Teams Calling)

You must not:

  • use our voice services to make calls that constitute Spam, harassment or fraud;
  • use our services to generate artificially high call volumes or engage in toll fraud of any kind;
  • use switch devices or technical means to circumvent call rate limits or otherwise gain an unfair advantage on shared voice infrastructure; or
  • route or reroute traffic in a way not authorised under your service agreement.

Data centre co-location

You must not:

  • use co-location facilities to host equipment involved in any activity prohibited by this policy;
  • tamper with, damage or interfere with the equipment of any other co-location customer or with Caznet's facility infrastructure; or
  • exceed the power, space or connectivity allocations specified in your service agreement without prior written approval.

7 What happens if you breach this policy

If we reasonably believe you have breached this policy, we may take one or more of the following actions:

  • investigate the breach, which may or may not involve contacting you directly;
  • request that you change the way you use our services;
  • issue a formal written warning;
  • restrict, suspend or terminate your access to our services, with or without notice; or
  • take any other action available to us under our service agreement or applicable law.
If we reasonably believe you have broken the law, we will report the matter to the relevant authorities and may provide them with your account and personal information as required. See our Privacy Policy for more detail on how we handle personal information.
